1. Scope and storage of these Terms
1.1 These Terms & Conditions apply exclusively to the business relationship between you and Precon GmbH & Co. KG and/or the Precon Group of Companies in the version valid at the time of your order.
1.2 You can view our Terms & Conditions on the website www.stillyou.health under “AGB”.
1.3 You may print or save this document using the standard function of your internet browser.
1.4 You may also archive the details of your order by downloading these Terms & Conditions or by saving the automatic order confirmation email we send to the email address you provided after completing your order. This order confirmation includes the details of your order and can be printed or saved via your email program.
2. Conclusion of contract
2.1 By placing an order, you submit an offer to us to conclude a purchase agreement. When you place an order online with Precon, we will send an email to the email address you provided confirming receipt of your order and listing its details (order confirmation). This email will also be sent for written or telephone orders, provided we have an email address from you.
2.2 The contracting party is Precon AG. Acceptance of your offer takes place within one week or by dispatching the goods within the same period.
2.3 Precon does not offer products for purchase by minors. Please note that we sell all products only in quantities customary for private households. This applies both to the number of products ordered within a single order and to multiple orders of the same product where each individual order represents a customary household quantity.
2.4 In the event of typographical, printing, or calculation errors, Precon is entitled to withdraw from the contract or to charge the correct price. You are also granted an immediate right of withdrawal in such cases. If an ordered item is not available, Precon may withdraw from the contract. Any payments already made will be refunded immediately.
3. Right of withdrawal
3.1 If you are a consumer (i.e., a natural person placing the order for purposes that cannot be attributed to your commercial or self-employed professional activity), you are entitled to a right of withdrawal in accordance with statutory provisions.
3.2 If you exercise your right of withdrawal as a consumer, the provisions set out in the cancellation policy (“Widerrufsbelehrung”) apply.
4. Delivery
4.1 Unless otherwise agreed, delivery is made from our warehouse to the delivery address specified by the customer. Delivery time with Swiss Post and the shipping option “PostPac Priority” is approximately 1 working day.
4.2 In addition to the stated product prices, shipping costs may apply. Further details regarding any applicable shipping costs can be found in the respective offers.
5. Warranty
5.1 If the package is visibly damaged upon delivery due to obvious transport damage, acceptance of the package must be refused.
5.2 If there is a defect in the purchased item for which Precon is responsible, Precon is entitled, at its own discretion, to remedy the defect or provide a replacement delivery. If Precon is unwilling or unable to remedy the defect or provide a replacement, or if this is delayed beyond reasonable deadlines for reasons attributable to Precon, or if the remedy or replacement fails in any other way, you are entitled—subject to statutory provisions—to demand subsequent performance, withdraw from the contract, reduce the purchase price, and/or claim damages.

5.4 Unless otherwise stated below, any further claims on your part—regardless of the legal grounds—are excluded. Precon is therefore not liable for damages that did not arise to the delivered item itself; in particular, Precon is not liable for lost profits or other financial losses. To the extent that Precon’s liability is excluded or limited, this also applies to the personal liability of employees, representatives, and vicarious agents. This limitation of liability does not apply where such limitation is prohibited by law. If Precon negligently breaches a material contractual obligation, liability for property damage or personal injury is limited to the damage typically foreseeable.
6. Due date and payment; default
6.1 The customer may pay the purchase price by invoice, PayPal, credit card (Visa or MasterCard), or PostFinance Card. In individual cases, we reserve the right to ship the goods only after advance payment. We will inform you shortly after receipt of your order confirmation and coordinate this with you.
6.2 If payment is made by credit card, your account will be charged upon completion of the order in the online shop. If payment is made by invoice, the purchase price becomes due immediately upon ordering and must be paid no later than 10 days after delivery of the goods. For orders with a value over CHF 99, delivery is free of shipping charges. The shipping fee for orders under CHF 99 is CHF 7.90.
6.3 Delivery of our items for orders placed on precon.ch can only be made within Switzerland.
6.4 If the customer is in default of payment, Precon AG is entitled to claim statutory default interest.
7. Right of retention
You are entitled to exercise a right of retention only insofar as your counterclaim arises from the same contractual relationship.
8. Retention of title and prices
Until full settlement of all claims against you, the delivered goods remain the property of Precon AG. All prices include the applicable value-added tax (VAT).
9. Applicable law
Swiss law applies.
